EXECUTIVE SEARCH AGREEMENT

            OUR UNDERSTANDING OF THE ASSIGNMENT

The details of the search assignments, including job specification for the positions will be provided to RK upon our engagement.

Our Approach
RK never advertise an executive search position.   Instead, we focus on research and making contacts via telephone discussions, face-to-face meetings and emails throughout the region to identify outstanding candidates for our clients.

RK Database and Network
Since inception, RK have contacted and interviewed close to 10,000 quality professionals in Malaysia and Asia Pacific region and the numbers are expanding daily through our contacts.  Most of them, when contacted, are aware that we are presenting an outstanding opportunity, one that they must consider seriously even if they are happily employed and not necessarily looking out. We know their goals - professional, personal, geographic and financial.

Strategic Alliances
RK explore other databases of professionals in Malaysia and Asia Pacific region. These names were gathered from every conceivable source, including articles in trade publications, newspaper, strategic partners in Malaysia and overseas, associations and industry contacts.  We have information about them: employment and personal profiles.  As we make contact with them, we learn much more about their background and experience. 

Management Team
Our Managing Director and three local partners are directly involved in all search assignments, with every assignment being led by a partner to ensure quality service for our valued clients. In RK, we are very transparent in our search process and we update our clients regularly on progress of the assignments.

After successful candidates have been identified, we continue to maintain close liaison with both clients and candidates to ensure smooth, timely and successful employment offers. These involve salary negotiations, arranging for medical examinations and finalizing on the job commencement date.

It is important to note that in the executive search process, we will be identifying people from the market who may be quite contented in their current positions. In this regard, we adopt a pull approach and work closely with our clients to attract and convince suitable candidates that they are making the right career moves in terms of company, job / career path and compensation package

           
            SEARCH METHODOLOGY

As executive search consultants, we conduct a comprehensive, confidential search for outstanding candidates in a systematic, orderly manner. Because we recognize the importance of the search to your organization, we make every effort to satisfy your requirements, thoroughly and expeditiously, with outstanding candidates who are qualified according to your specifications. 
 
To provide a better understanding of how RK works, we have outlined the key steps of our search process:

Our first priority is to obtain an understanding of your organization, its structure, mode of operation, product, personalities involved, the position and its responsibilities, and qualifications and characteristics you seek in the potential candidate. Finalize the precise job title, specifications, responsibilities and qualifications of the individual to be considered and agree with you the terms of employment, including the compensation and benefits package. 
We also need to know the information that is considered confidential, because we will use that in discussion with the potential candidates.
We research nationally and regionally to identify candidates uniquely qualified to meet your job specifications. We utilize all avenues, including our extensive database to identify those individuals who may be qualified and interested in exploring options.  We have the contacts to identify exceptional candidates with proven track records.  Develop a list of prospective candidates who appear to match your requirements.  We will continue to discuss and review the list with you to gain a better understanding of the unique requirements that may not appear in the initial discussion.
Potential candidates are contacted and interviewed to determine if they are qualified and interested. We explore the scope and quality of experience, suitability to the specifications, motivation, potential, and viability for relocation, if necessary.  Conduct extensive discussions and interviews with relevant individuals to improve and refine the list of prospective candidates.  Following interviews with potential candidates, in which we will determine their relevant qualifications and levels of interest, we will develop a short list of those who appear best qualified.
Selected candidates are presented, and their experience and qualifications are discussed with you.  We will prepare a summary report describing both professional and personal background.  Because we know our industry and the players, we usually can make a presentation of qualified candidates within 2 weeks.  Before we introduce them to you, they will be fully interviewed, to your specifications. 
After you have reviewed the candidates' profile, we will arrange for you to meet the candidates in a location of your convenience.  There are many factors, including salary, job responsibility and location when we decide on how many candidates we send to you. Our policy is we will not submit a candidate unless the new candidate is as good, or better than, those we have already submitted. However, we will continue to present excellent candidates until the position has been filled. Throughout the search, we keep you informed of our progress, and maintain continual contact in the negotiation stage until a candidate is selected and has accepted.
Our assignment is considered complete, upon acceptance of the letter of employment by the successful candidate. 
Information for any candidate submitted to you remains propriety information of RK.  If any of these candidates are employed at any time, the search fee as agreed herein is due and payable to RK.


N/B:         In order to avoid duplication of effort or confusion, please refer to us any candidate that you have sourced or identified during the search process, to enable us to assess, interview and shortlist should they be suitable for the position.
 

            OUR GUARANTEE

In the unlikely event that the successful candidate leaves the job or (the client) finds the candidate not suitable for the position within three (3) month’s of the employment, RK will conduct one (1) more search to replace the candidate at no additional fee.
 

            FEES AND EXPENSES

In view of RK’s commitment and keen interest to build a long-term relationship with (the client), we are willing to undertake executive search assignments on an exclusivity basis at a discounted fee from our standard fee rate of 30%.  Therefore, our fee shall be based on a special fee rate at 18% of the successful candidate’s annual gross cash compensation (including any fixed allowances), plus 5% Government Service Tax. 
 

            FEE BILLING STRUCTURE

A retainer fee of one third of our expected final fee but not exceeding RM10, 000.00 is normally charged before starting each assignment, to cover our professional time and resources as the search progresses.  This fee is fully deductable against the final fee.  However, in this case, we will charge a minimal token of RM2,500.00 retainer fee for each positions. This retainer fee is payable upon acceptance and confirmation of the terms and conditions. The final fee will be payable upon candidate’s acceptance of offer.
In the event, RK is unable to fulfill the position required by (the client) for whatever reason, we will use the retainer fee as a retainer fee for the next assignment given to us by (the client)
 

            CONFIDENTIALITY

We will keep confidential all information regarding (the client) that are available to us on a client basis and will take all possible precautions to protect its interests.  This proposal contains confidential information for the use of (the client) that it will not disclose to third parties without the consent of RK.
 

            TERMINATION

This Agreement may be terminated by either party upon written notice to each other.
 

            COMMITMENT

RK is committed to assist (the client) through strategically placing the most qualified candidates to ensure a strong structure for its future growth and development. 
Our goal is to convince (the client) that RK is an important long-term partner in executive search.
